Elandsfontein Update re: Notice of Motion application by World Wildlife Fund South Africa
Kropz plc (AIM: KRPZ), an emerging African phosphate producer, notes recent reports that a lawsuit has been lodged by the World Wildlife Fund South Africa ("WWF-SA") against South Africa's Ministry of Forestry, Fisheries and Environment ("DFFE") over its decision to dismiss appeals against an environmental offset exemption granted to the Elandsfontein mine, which is owned by the Company.
On 10 September 2024 the Minister of the DFFE who acts as an environmental appeal authority, upheld the decision of the Minister of the Department of Minerals and Energy ("DMRE") to remove the offset requirement from Kropz Elandsfontein (Pty) Ltd ("Kropz Elandsfontein") Environmental Management Program (EMPr).
Kropz Elandsfontein confirms that WWF-SA filed a Notice of Motion application to the High Court in South Africa to review the decision of the DFFE Minister, and that Kropz Elandsfontein has been named as the third respondent.
Kropz Elandsfontein confirms that WWF-SA's High Court application does not affect its day to day operations. Kropz Elandsfontein is in good standing with all its permitting government departments, including the Department of Water which administers and monitors its Water Use License.
Kropz Elandsfontein intends to oppose the WWF-SA motion as the third Respondent and is taking legal advice regarding the matter. Further updates will be provided as appropriate.
